Welcome to Collaborative Family Engagement Mobile Application, hereby referred to as CFE app, the app, app, hosted and managed by Texas CASA, Inc.

These terms and conditions outline the rules and regulations for the use of CFE app.

By accessing this app you accept these terms and conditions. Do not continue to use this app if you do not agree to all of the terms and conditions stated on this page.

1. This app is available for free download in Texas by those working for or volunteering with Court Appointed Special Advocates (CASA), Child Protective Services, or Community-Based Care providers (hereby referred to as SSCCs) who are involved and trained in Collaborative Family Engagement (CFE).
2. This app is intended to be used in person by a CASA staff, volunteer or CPS/SSCC staff with a child, youth, parent or family member, for the purposes and goals of Collaborative Family Engagement and will be used ethically, responsibly and in accordance with respective roles and duties.
3. This app is designed to be used in conjunction with other CFE work, and is not a standalone delivery method.
4. This app does not provide full explanation or training of the tools provided therein, and is intended to be used after the user has been trained in the tool use and application. 
5. This app may not have the most up to date information and does not represent the entire training curriculum required of a CASA volunteer, CASA staff, CPS or SSCC staff.
6. Use of this app must adhere to the local CASA program board-approved written policies and procedures regarding confidentiality of case information and records in accordance with CASA Standards, the Texas Family Code and other applicable law, and/or confidentiality practices, policies and guidelines of DFPS or SSCCs.
7. The CASA staff or volunteer app user will assume full responsibility for ensuring all electronic records in their possession are either destroyed or kept in safe, secure storage for seven years, or longer as determined by the local CASA program board-approved policies. CPS/SSCC app users assume full responsibility for ensuring all electronic records in their possession are kept safely secured in accordance with DFPS/SSCC policies. 
8. Identifying or confidential information of children, youth or families involved in the foster care system should not be recorded in the app.  
9. This app is intended to be used by the account holder and access to the app and its contents therein is not to be shared with people other than the account holder.
10. Any disclosures alleging abuse or neglect of a minor made to the account holder by a child, youth or family member while using the CFE app should be reported to the DFPS Abuse Hotline at 1-800-252-5400 along with other local CASA program and/or CPS/SSCC reporting policies.   
11. The CFE app may be used in conjunction with but does not replace other CASA or CPS/SSCC duties and responsibilities, face to face visit requirements, or court proceedings. The CFE app is not legally binding nor to be considered as legal advice.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person logged in on this app and compliant to the Company's terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to Texas CASA, Inc. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services, in accordance with and subject to, prevailing law of Texas.  Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

We employ the use of cookies. By accessing this app, you agreed to use cookies in agreement with the app’s Privacy Policy.

Most interactive apps use cookies to let us retrieve the user's details for each visit. Cookies are used by the app to enable the functionality of certain areas to make it easier for people using the app.

Unless otherwise stated, Texas CASA Inc. and/or its licensors own the intellectual property rights for all material on this app. All intellectual property rights are reserved. You may access this from the app store for your own personal use subjected to restrictions set in these terms and conditions.

You must not:

• Republish material
• Sell, rent or sub-license material 
• Reproduce, duplicate or copy material 
• Redistribute content 

This Agreement shall begin on the date hereof.

Content Liability

Texas CASA Inc. shall not be held responsible for any content, issues or outcomes that arise out of the use of the CFE app.  Any disclosures of neglect or abuse of a minor made to you by a child, youth or family member while using the CFE app should be reported to the DFPS Abuse Hotline at 1-800-252-5400 along with other local CASA program and/or CPS/SSCC reporting policies.   

Reservation of Rights

Texas CASA Inc. reserves the right to request that you remove all links or any particular links or mentions/tags to the CFE app. You agree to immediately remove all links/tags to CFE app upon request. Texas CASA Inc. also reserves the right to amend these terms and conditions and its linking policy at any time. By continuously linking to CFE app, you agree to be bound to and follow these linking terms and conditions.

If you find any information in this app that is offensive for any reason, you are free to contact and inform us any moment. Texas CASA Inc. will consider requests to remove but is not obligated to or so or to respond to you directly.

Texas CASA Inc. strives to ensure information and instructions in the CFE app are accurate and kept up to date. For the most up to date information, please visit www.texascasa.org.

Disclaimer

To the maximum extent permitted by applicable law, Texas CASA Inc. excludes all representations, warranties and conditions relating to the CFE app and the use of this app. Nothing in this disclaimer will:

• limit or exclude our or your liability for death or personal injury;
• limit or exclude our or your liability for fraud or fraudulent misrepresentation;
• limit any of our or your liabilities in any way that is not permitted under applicable law; or
• exclude any of our or your liabilities that may not be excluded under applicable law.

The limitations and prohibitions of liability set in this Section and elsewhere in this disclaimer: (a) are subject to the preceding paragraph; and (b) govern all liabilities arising under the disclaimer, including liabilities arising in contract, in tort and for breach of statutory duty.

As long as the CFE app and the information and services on the CFE app are provided free of charge, Texas CASA Inc. will not be liable for any loss or damage of any nature.
